A judge in Glendale, Arizona, has ruled that Fanatics, a sports merchandise company, can refile its lawsuit against Arizona Cardinals wide receiver Marvin Harrison Jr. The lawsuit, initially filed in May, alleges breach of contract involving a binding term sheet that Fanatics claims was signed by Harrison Jr. However, recent affidavits from both Harrison Jr. and his father, Marvin Harrison Sr., assert that it was Harrison Sr. who signed the document, not Harrison Jr.
Harrison Jr. maintains that the agreement was between Fanatics and his company, The Official Harrison Collection, rather than himself personally. He claims he never intended to be personally bound by the term sheet and was not obligated to sign any document concerning it. This assertion is supported by Harrison Sr., who stated he signed the term sheet as an authorized representative of the company.
The binding term sheet in question indicated that Harrison Jr. was to earn $1.05 million from Fanatics between April 2024 and March 2026 for game jerseys and over 35,000 autographs. Despite this, Harrison Jr. argues that the $110,000 he received for autographs from August to October 2023 was paid to The Official Harrison Collection via Topps, a trading card company acquired by Fanatics, and not to him personally.
Fanatics has expressed surprise at these revelations, noting that the signature on the binding term sheet appears to be “MHJ,” which aligns with how Harrison Jr. signs items for The Official Harrison Collection. The company has about two weeks to refile the lawsuit, which now includes some previously redacted details.
Both parties have expressed a desire to resolve the matter through mediation, as indicated in separate filings by their attorneys this week. Harrison Jr. also disputes the lawsuit’s claim that his company is his “alter ego/agent,” citing the company’s independent bank accounts and federal tax identification number as evidence of its separate legal identity. Furthermore, Harrison Jr. contends that neither he nor his company have conducted business in New York, where the lawsuit was filed
